1. WHAT INFORMATION DO WE COLLECT?

In Short: Most of your data stays on your iPhone. While app analytics is switched on, usage events go to Google Firebase Analytics. Our website and your emails to us are processed by our providers.

No account. Omit does not need an account. You do not give us an email address, username or password to use the App.

Data that stays on your device. The following is stored only on your iPhone: the first name you enter during setup, the age group you select, the daily screen time you estimate during setup, your daily limits for each weekday, your screen time measured against those limits, banked minutes, emergency passes, your Focus Stamp collection and unlock history, and your notification settings. We do not receive this data, except for the figures listed under "App analytics" below. Screen-time data comes from Apple's Screen Time framework and is processed on your device. We cannot see which apps or websites you use.

App analytics (Google Firebase Analytics). App analytics is switched on by default. While it is on, the App sends usage events to Google Firebase Analytics: screens you open, app opens, your daily limit and remaining minutes, whether your limit was reached or your apps were unlocked, limit changes, use of banked time and emergency passes, when the purchase screen is shown or closed, the age group you selected during setup, which Focus Stamp tier and design you bought and its price, failed purchases, and the fact that you deleted your data in the App. Firebase also collects an app instance ID, device model, operating system and app version, language, approximate country derived from your IP address, and time of use. We do not send your name to Firebase. You can switch app analytics off at any time in the App under Settings > Analytics. From then on, no further events are sent.

Sensitive Information. We do not ask for special categories of personal data (such as health data), photographs, facial images or biometric data. Your detailed screen-time data (which apps you use and for how long) stays on your device. While app analytics is switched on, summary figures such as your daily limit, remaining minutes and whether you reached your limit are sent to Firebase Analytics as described above.

Payment Data. Focus Stamps are one-time in-app purchases sold through the Apple App Store. Apple processes your payment as an independent controller under its own privacy policy (apple.com/legal/privacy). We do not receive or store your payment card details. The App receives confirmation of a successful purchase, the product and the price. It stores these on your device and, while app analytics is switched on, also sends the tier and price to Firebase Analytics.

Emails to us. If you write to us, for example through the support link in the App, we process your email address, the content of your message and anything else you include. When you use the support link in the App, your email is pre-filled with the App version, the iOS version and your device model; you can delete these before sending.

Our website. When you visit omitapp.com, our hosting provider Cloudflare processes your IP address, browser type, the page requested and the time of access to deliver the site and protect it from attacks. Our website stores one cookie, omit_cookie_consent, that records your cookie choice (see Section 6).

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to run the App, deliver your purchases, improve the App, deliver and secure our website, answer your emails, and comply with the law.

  • To run the App's features, such as tracking your screen time against your limits, showing reminders and tips, and managing your Focus Stamps. This happens on your device.
  • To process your in-app purchases of Focus Stamps and unlock your apps when you buy one.
  • To understand how the App is used and improve it through Firebase Analytics, while app analytics is switched on.
  • To deliver and secure our website.
  • To answer your emails.
  • To comply with legal obligations and to establish, exercise, or defend legal claims.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR PERSONAL INFORMATION?

In Short: Each purpose has its own legal basis under the GDPR, listed below.

  • Running the App's features and delivering Focus Stamps you buy: performance of a contract (Art. 6(1)(b) GDPR).
  • App analytics (Firebase Analytics): our legitimate interest in understanding how the App is used and improving it (Art. 6(1)(f) GDPR). You can object at any time by switching off Settings > Analytics in the App.
  • Answering your emails: performance of a contract where your message concerns the App, otherwise our legitimate interest in replying to inquiries (Art. 6(1)(b) or (f) GDPR).
  • Hosting and securing the website (Cloudflare server data): our legitimate interest in a secure, working website (Art. 6(1)(f) GDPR).
  • The omit_cookie_consent cookie: it is strictly necessary to remember your cookie choice, so we set it without consent (§ 25(2) No. 2 TDDDG). The related processing is based on Art. 6(1)(c) GDPR in conjunction with Art. 7(1) GDPR.
  • Keeping records required by tax and commercial law: legal obligation (Art. 6(1)(c) GDPR).
  • Defending legal claims: our legitimate interest in protecting our rights (Art. 6(1)(f) GDPR).

4. WHO RECEIVES YOUR PERSONAL INFORMATION?

In Short: Apple, Google (Firebase Analytics), Cloudflare and our email providers. We do not sell your personal information.

  • Apple Distribution International Ltd. (Ireland): distributes the App and processes in-app purchases as an independent controller.
  • Google Ireland Limited / Google LLC: Firebase Analytics, while app analytics is switched on (processor).
  • Cloudflare, Inc.: hosting and security of omitapp.com, and routing of emails sent to [email protected] (processor).
  • Apple (iCloud Mail): emails sent to [email protected] are forwarded to and stored in our iCloud Mail mailbox (processor).
  • Professional advisers and authorities: where the law requires it, or to establish, exercise or defend legal claims.
  • Business transfers: a buyer of our business in a merger or sale.

Every processor we use works under a data processing agreement with us.

Google Firebase Analytics. We use Firebase Analytics, a service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, to understand how the App is used and to improve it. Firebase processes the events and device data described in Section 1 together with an app instance ID. Google processes this data on our behalf. Data may be transferred to Google LLC in the United States; Google LLC is certified under the EU-U.S. Data Privacy Framework. Legal basis: our legitimate interest (Art. 6(1)(f) GDPR). You can switch app analytics off at any time in the App under Settings > Analytics. More information: firebase.google.com/support/privacy.

5. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES?

In Short: We are not responsible for the safety of any information that you share with third parties that we link to but are not affiliated with.

The Services may link to third-party websites, online services, or mobile applications. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this Privacy Notice. We are not responsible for the content or privacy and security practices and policies of any third parties. You should review the policies of such third parties and contact them directly with any questions.

6. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: Our website sets one cookie, which stores your cookie choice. We do not use analytics or advertising cookies on our website. The App does not use cookies.

Website

Our website omitapp.com does not use analytics or advertising cookies, pixels or tags. We use only the following:

  • omit_cookie_consent (first party, set by us). Purpose: stores your cookie choice so we do not ask you again. Duration: 365 days.
  • Cloudflare (Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA): hosts and protects the website and decodes the email addresses shown on the site with a small script. When you open a page, your browser sends the technical data needed to deliver it: IP address, date and time, the page requested, referrer URL, browser type and operating system. Cloudflare also uses this data to protect the website from attacks. Legal basis: our legitimate interest in delivering a secure and working website (Art. 6(1)(f) GDPR). Cloudflare may process data in the USA; Cloudflare, Inc. is certified under the EU-U.S. Data Privacy Framework.

The analytics and marketing options in our cookie banner have no effect today, because no analytics or marketing tools run on our website. To change your choice, delete the omit_cookie_consent cookie in your browser settings; the banner then appears again on your next visit.

App

The App does not use cookies. While app analytics is switched on, Firebase Analytics stores an app instance ID on your device (see Section 1). The App does not use the advertising identifier (IDFA) and does not track you across other companies' apps or websites.

7. DO WE USE ARTIFICIAL INTELLIGENCE?

In Short: No.

Omit does not use AI services. Reminders and tips in the App are created on your device from fixed rules based on the limits you set. We do not make decisions about you that have legal or similarly significant effects (Art. 22 GDPR).

8. IS YOUR INFORMATION TRANSFERRED OUTSIDE THE EU?

In Short: Some of our providers may process data in the United States under the EU-U.S. Data Privacy Framework.

Google LLC, Cloudflare, Inc. and Apple Inc. may process data in the United States. All three are certified under the EU-U.S. Data Privacy Framework, for which the European Commission has issued an adequacy decision (Art. 45 GDPR). Where a provider is not certified, we use the European Commission's Standard Contractual Clauses (Art. 46(2)(c) GDPR). You can request a copy of these safeguards at [email protected].

9. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: Each type of data has its own retention period, listed below.

  • Data on your device stays there until you delete it in the App under Settings > Delete Account or remove the App.
  • Firebase Analytics event data is kept for up to 14 months and then deleted automatically by Google. Deleting your data in the App does not delete analytics data already sent.
  • Emails to us are kept as long as needed to deal with your request, and then for up to 3 years in case of follow-up questions, unless longer statutory retention applies.
  • Cloudflare keeps website server data only as long as needed to deliver and secure the website.
  • Records we must keep under tax and commercial law are kept for the statutory periods (up to 10 years under § 147 AO and § 257 HGB).

10. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. You should only access the Services within a secure environment.

11. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your location, you have rights that allow you greater access to and control over your personal information.

If you are located in the EEA or UK, you have the following rights under applicable data protection law: the right to request access to and a copy of your personal information (Art. 15 GDPR); to request rectification (Art. 16) or erasure (Art. 17); to restrict processing (Art. 18); to data portability (Art. 20); and to object to processing (Art. 21).

Your right to object (Art. 21 GDPR). Where we process your data based on our legitimate interests (Art. 6(1)(f) GDPR), you can object at any time for reasons arising from your particular situation. We will then stop, unless we can show compelling legitimate grounds that override your interests, or we need the data to establish, exercise or defend legal claims. If we ever process your data for direct marketing, you can object at any time without giving reasons, and we will stop. To object to app analytics, switch off Settings > Analytics in the App. For anything else, email [email protected].

Do you have to give us your data? You are not legally required to give us any data. Without the technical data your browser sends, we cannot show you the website. Without the purchase record, the App cannot unlock features you buy. You can use the App with app analytics switched off.

Right to complain. You also have the right to lodge a complaint with a data protection supervisory authority. Our competent authority is Die Landesbeauftragte für den Datenschutz und für das Recht auf Akteneinsicht Brandenburg (LDA Brandenburg) (website: lda.brandenburg.de). You may also contact the supervisory authority in your country of habitual residence.

To exercise any of these rights, contact us at [email protected]. We may need to verify your identity before responding to a request.

12. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. Our website does not use tracking tools, so there is nothing for a DNT signal to switch off. In the App, you can switch off app analytics under Settings > Analytics.

13. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: If you are a resident of certain US states, you may have additional rights regarding your personal information.

Depending on your US state of residence, you may have the right to know what personal information we collect and how we use it, to access a copy, to correct it, to delete it, and to opt out of the sale of personal information, of sharing for cross-context behavioral advertising, of targeted advertising and of profiling with legal or similarly significant effects. We do not sell your personal information, and we do not share it for cross-context behavioral advertising or targeted advertising. We do not use it for profiling that has legal or similarly significant effects. We do not use sensitive personal information to infer characteristics about you. We do not knowingly sell or share personal information of consumers under 16.

In the past 12 months we collected these categories, as described in Section 1, for the purposes in Section 2: identifiers (app instance ID, IP address), commercial information (in-app purchase records), internet or other electronic network activity (website requests, app usage events), approximate location derived from IP address, and age group. We disclosed them for business purposes only to the service providers named in Section 4.

To exercise your rights, email [email protected]. We will verify your request by matching information you give us with information we hold, and we may ask you for more. You may use an authorized agent. If we deny your request, you can appeal by replying to our decision with the subject "Appeal"; we will answer within 45 days. We will not discriminate against you for exercising your rights. We honor Global Privacy Control (GPC) signals on our website as a request to opt out of sale and sharing; because our website does not sell or share data, no further change is needed when we receive one.

14. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, when our processing or the law changes.

We update this notice when our processing or the law changes. The "Last updated" date at the top shows the current version.

15. HOW CAN YOU CONTACT US ABOUT THIS NOTICE?

If you have questions or comments about this notice, you may email us at [email protected] or contact us by post at:

Dumke Ventures UG (haftungsbeschränkt)
Ebersprung 2
16321 Bernau
Germany

Managing Director (Geschäftsführer): Tom Dumke. Our full legal notice is available in our Impressum.

16. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

You have the right to request access to the personal information we collect from you, details about how we have processed it, correction of inaccuracies, or deletion of your personal information. These rights may be limited in some circumstances by applicable law.

To delete everything stored on your device, use Settings > Delete Account in the App. This deletes your name, age group, limits, screen-time history, banked minutes and Focus Stamp collection from your device and resets the App. While app analytics is switched on, the App sends one last event to Firebase Analytics when you do this, with your current limit figures, your number of stamps and the days since setup. Deleting in the App does not delete analytics data already sent.

Firebase Analytics data is linked only to a random app instance ID, not to your name or email address, so we usually cannot find a specific person's analytics data on request (Art. 11 GDPR). It is deleted automatically after the period in Section 9. To request a copy or deletion of your emails or any other data we hold, email us at [email protected].

17. MINIMUM AGE

Omit is intended for people aged 16 and older. We do not knowingly collect personal data from children under 16. If you are a parent or guardian and believe your child under 16 has sent us personal data, contact us at [email protected] and we will delete the data we can link to your child.
